Multiclass Trademark Registration

The process for filing a multiclass trademark application is similar to the process of filing an application under a single class. You can add different classes in one single Trade Mark Application. You can do so by filling the Application in class 99 in which you can add two or more than two classes. However you will have to pay the government fee for each and every class you are applying for. It will save time and effort when a Applicant’s products are vast and belong to multiple classes and single class applications are filed. There will have to be multiple single class applications, which would need to be filed separately. However, in a Multiple Class Application, all the classes the product belongs will be clubbed into a single application for trademark registration.

However it is not advisable to apply in multiple classes unless you are sure that your Trade Mark/Brand won’t get any objection or opposition, otherwise even if the Mark gets objected/opposed in one class, the same will be objected over all, i.e. in all classes.

Before proceeding with the trademark application, it is always advisable to carry on a trademark search. As the Application is being filed under multiple class, a search has to be conducted by the applicant under all the relevant classes the Mark is being filed. It has to be thoroughly searched, if a similar trademark exists under any single class the applicant is intending to trademark the brand name.

If a similar trade name should exist in just one of the classes, and not in the others, there would be a rejection raised for that respective class which might eventually result in getting the application rejected under all the classes the application was made for. 

For example, you want to apply for a Mark “SUGANDH” in class 3 and 9 and you apply the same in multiple classes 99. There is some Mark already existed in class 3 so the Mark gets objected even in class 9 and now you will have to wait for the all process to be completed before the same gets registered. However if you had filed the same Application separately in class 3 and class 9, there was high chance of the Mark in class 9 to get registered without any objection, while the Application in class 3 will go through all the necessary process of Acceptance.

That’s why, we as an Attorney advise to file different Application in different classes.
